. Respondent/Complainant Petition under Section 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to enlarge the petitioner on bail in Cr. No.12/2014 of Badvel (U) PS., Kadapa District.
The petition coming on for hearing, upon perusing the Petition and the grounds filed herein and upon hearing the arguments of Sri M.S.P. Kamaraju, Advocate for the Petitioner and of the Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“The petitioner is A-2. He seeks for grant of bail. He allegedly committed offences under Sections 353, 307 and 379 read with Section 34 IPC and under the provisions of A.P. Forest Act.
The petitioner allegedly indulged himself in the smuggling of red sandalwood . The prosecution alleged that the petitioner and others attacked the police pelted with stones, sticks and axes. However, no serious injuries by the accused to any of the police officials. I, therefore, consider it appropriate to enlarge the petitioner on bail. However, in view of the nature of the allegations that the petitioner is indulging in red sandalwood smuggling activity, I consider it appropriate to enlarge the petitioner on bail on terms only.
Accordingly, this Criminal Petition is allowed. The petitioner is enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to the satisfaction of the learned Judicial Magistrate of First Class, Badvel, Kadapa District. After his release, the petitioner shall appear before the SHO, Badvel Police Station on every day between 9.00 AM and 6.00 PM for a period of three months.”
