Heard Sri Ashwini Kumar Srivastava, learned counsel for the petitioners, N.K. Verma, learned A.G.A. for the State and perused the impugned F.I.R. as well as material brought on record.
This petition has been filed by the petitioner with a prayer to quash the F.I.R. dated 11.8.2017 registered as case crime no.0179 of 2017 under sections 147, 148, 149, 452, 307, 352, 504, 506 I.P.C., police station Mundali, District Meerut.
Learned counsel for the petitioners submits that the petitioner had earlier lodged FIR against the respondent no. 3 and others and the petitioners have received serious injuries on their persons. He further submits that this is a no injury case and this fact has been mentioned in paragraph no. 5 of the writ petition.
Learned A.G.A. opposed the prayer for quashing.
Considering the submissions advanced by learned counsel for the parties and nature of the allegations, it is directed that the petitioners shall not be arrested in above mentioned case, till the submission of the police report under section 173(2) Cr.P.C. but they shall co-operate with the investigation of the case.
It is made clear that if there appears to be any injury, the order passed by this Court shall automatically be discharged.
