Vakalatnama of Sri B.N. Mishra and Sri R.V. Mishra on behalf of respondent no.8 has been filed today in the Court. The same is taken on record.
Heard Sri Anil Kumar Shukla, learned counsel for the petitioners, Sri Dinesh Kumar Mishra holding brief of Sri Diwakar Singh, learned counsel for the respondent no.6, Sri B.N. Mishra and Sri R.V. Mishra, learned counsel for the respondent no.8 and Sri Dhirendra Singh, brief holder on behalf of the State-Respondents no.1 to 5.
The petitioners in the writ petition are seeking quashing of the enquiry report dated 15.02.2018 in which certain complaints made against the respondents no.7 and 8 were enquired into and thereafter it was found that there was no substance in those complaints. This enquiry was conducted by the Chief Development Officer, Allahabad.
Learned counsel for the petitioners submits that the petitioners have worked under the MGNREGA Scheme but they have not been given any payment for the year 2016-17. However, in paragraph 3 of the writ petition it is stated that the petitioners are villagers and permanent resident of village Chandi, Post Nathaupur, Tehsil Koraon, District Allahabad and they are energetic and responsible members of the village and fighting against the corruption and injustice for poor people. This shows that the petitioners are not fighting for themselves but are busy body, wayfarer and interloper, who are prosecuting this case against respondents no.7 and 8.
In this view of the matter, the submission made by the learned counsel for the petitioners at the bar are contrary to the averments of paragraph 3 of the writ petition.
The petitioners have, therefore, no locus to maintain this writ petition and the same is accordingly dismissed.
