Heard learned counsel for parties and perused the record.
Submission of learned counsel for petitioner is that present writ petition has been filed for payment of post retiral dues of the petitioner including arrears of pension and Group Insurance etc. A short counter affidavit has been filed on behalf of opposite party no.. 4, mentioning therein that pension and gratuity of the petitioner were recommended by the Nagar Palika Parishad, Akbarpur to the District Magistrate/ Commissioner, Faizabad. The Commissioner finally sanctioned the pension of the petitioner and wrote a letter to the Branch Manager, State Bank of India, Akbarpur, district Ambedkar Nagar for payment of regular monthly pension amounting to Rs. 3937/- per month w.e.f. 01.01.2011 and gratuity amounting to Rs . 2,15,553/- and the information was also sent to the petitioner. The Executive Officer, Nagar Palika Parishad also issued a letter dated 22.11.2011 to the petitioner directing him to contact the bank concerned for payment.
It is also mentioned in the short counter affidavit that when petitioner informed to the Nagar Palika Parishad that his gratuity and pension has not been transferred to his bank account, then the Executive Officer (Opposite Party No. 4) wrote a letter dated 4.2.2012 (Annexure No. SCA-1) to the Bank for transfer of amount of pension and gratuity to the account of petitioner immediately. Thereafter the opposite party no. 4 has also taken statement of account of the petitioner's bank account on 06.2.2012 (Annexure No. SCA-2) which shows that the amount of gratuity and pension (with arrears) has been transferred in his account.
In view of the above, there remains nothing to be adjudicated in this writ petition.
Writ Petition is, therefore, dismissed having become infructuous.
