The marital disputes between the petitioner and the respondent were settled as per Annexure A1 memorandum of agreement and compromise decree passed. This compromise decree has been sought to be recalled by the respondent wife in I.A. No. 860/2014 in OP(G&W) No. 1908/2011. The petitioner husband has on the other hand filed E.P. No. 53/2013 in OP(G&W) No. 1908/2011 to execute the compromise decree.
2. Interest of justice would be met by directing the Family Court, Thiruvananthapuram to dispose of I.A. No. 860/2014 in OP(G&W) No. 1908/2011 within a period of three weeks. E.P. No. 53/2013 in OP(G&W) No. 1908/2011 shall be dealt with dependent on the orders in I.A. No. 860/2014 in OP (G&W) No. 1908/2011. The compromise decree subject to variation (if any) shall be enforced in full vigour by the Family Court, Thiruvananthapuram.
The Transfer Petition is disposed of.
