JUDGMENT / ORDER

1. Heard Mr. Dave, learned advocate for the petitioner and Mr. Joshi, learned advocate for respondent No.2.
2. Mr. Dave, learned advocate for the petitioner has submitted that during the pendency of the petition, the respondent authority has cancelled the communication dated 17.4.2012. He also submitted that the order dated 26.9.2012 has been passed without hearing the petitioner.
2.1 Mr. Dave, learned advocate for the petitioner has, so as to bring the said factual aspect on record, circulated draft amendment dated 16.10.2012 seeking permission to amend the petition so as to add paragraph No.7 (A) and paragraph No.12 (AA) in the petition.
3. Mr. Joshi, learned advocate for the respondent has submitted that subject to his right to file reply he has no objection if the petitioner's request for amending the petition is granted.
4. Therefore below mentioned order is passed:-
(A) The petitioner is permitted to amend the petition as per draft amendment dated 16.10.2012 i.e. so as to add paragraph No. 7 (A) and paragraph No. 12 (AA).
(B) Amendment to be carried out on or before 3.11.2012.
(C) The respondents may to file reply affidavit dealing with the details brought on record by virtue of the amendment. They may file the affidavit on or before next date of hearing.
