The petitioner claims that she appeared in all the papers of U.P.D.El.Ed-2017 2nd Semester Examination including Paper-I, Paper-II and Paper-V. However, the results record the words "Incomplete". The endorsement of the "BLK" has been made in the aforesaid subjects of "वररममान भमाररतीय सममाज एववं पमारभवं भक भशिकमा , पमारभवं भक भशिकमा कक नवतीन पयमास and समाममाजजक अध्ययन" Against the subjects the words "BLK" has been recorded and is explained as blank due to number missing or other reason.
Learned counsel for the petitioner submits that there is no reason to withhold the marks of the petitioner in the aforesaid subjects, inasmuch as, the petitioner duly sat in the examinations of the said subjects. The petitioner has appended the attendance-sheet of the examination center which attests the fact that the petitioner appeared in the aforesaid examinations. The petitioner has made a representation in this regard. The only submissions made by Sri Sheetala Prasad Pandey, learned counsel for the petitioner is that the representation of the petitioner may be decided within a stipulated period of time since the same has not been decided till date.
Learned Standing Counsel does not have any serious objection to the aforesaid prayer.
The matter is remitted to the respondent No.2- Examination Regulatory Authority, U.P. Allenganj, Prayagraj.
A writ of mandamus is issued commanding the respondent No.2-Examination Regulatory Authority, U.P. Allenganj, Prayagraj to decide the representation of the petitioner for declaring his examinations results in the subjects of paper-I वररममान भमाररतीय सममाज एववं पमारभवं भक भशिकमा , paper-II पमारभवं भक भशिकमा कक नवतीन पयमास and paper-V समाममाजजक अध्ययन for the U.P.D.El.Ed-2017 2nd Semester Examination. The aforesaid representation shall be decided by a reasoned and speaking order within a period of 15 days from the date of receipt of a certified copy of this order along with a fresh copy of the representation.
The Court has not gone into the veracity of the assertions in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind.
With the aforesaid direction, the writ petition is disposed of.
