Heard learned counsel for the petitioner and learned Standing Counsel for the State.
By this petition, the petitioner has prayed for following reliefs:-
"i. Issue, a writ, order or direction in nature of mandamus directing/commanding the respondent no.5 to comply the order of respondent no.4 dated 16.2.2021 to construct Kharanza over Aarazi No. 193 measuring area 0.169 Hectare situated at Mahwikhas Block Mahrajganj, Tehsil Sagri, District Azamgarh;"
Facts stated in the petition cannot be ascertained in writ jurisdiction. However, as learned counsel for the petitioner has moved representation before the District Magistrate-respondent no.2, it is observed that as the material of the petitioner is lying since long and rainy season is to start and all order are in his favour, the respondent no.2 may passed reasoned order expeditiously, not later than 15th August 2021, if there are no legal impediment in the way of the respondent no.2.
It is made clear that this Court has not gone into merits of the case and it is the respondent no.2 who shall decide the representation in accordance with law.
With these observations, writ petition is disposed of.
