Court No. - 1
Case :- CRIMINAL MISC. WRIT PETITION No. - 19963 of 2018 Petitioner :- Brijlal Singh Respondent :- State Of U.P. And 7 Others Counsel for Petitioner :- Vikram Singh Counsel for Respondent :- G.A.
Hon'ble Ramesh Sinha,J. Hon'ble Dinesh Kumar Singh-I,J.
Heard Sri Vikram Singh, learned counsel for the petitioner, Sri N.K.Verma, learned A.G.A. for the State and perused the impugned FIR as well as material brought on record.
This petition has been filed by the petitioner with a prayer to direct the respondent no.2, S.S.P., Etah to ensure the fair investigation in pursuance of the FIR dated 1.6.2018, in Case Crime No.63 of 2018, under Sections 147, 436, 504 I.P.C., P.S. Jasarathpur, District Etah.
It has been contended by learned counsel for the petitioner that petitioner is the informant of the present case and he has come up before this Court with a prayer that direction be given to respondent no.2, S.S.P., Etah for fair investigation in the matter as he apprehends that investigation is not being carried out in a fair and proper manner.
Considered the facts and circumstances of the case and submissions advanced by learned counsel for the parties.
There appears to be no good ground for directing the respondent no.2, S.S.P., Etah to expedite the investigation in a fair manner as learned counsel for the petitioner has failed to demonstrate before this Court either from the record or from his argument as to why the investigation is not being carried out in a fair manner and there appears to be only vague averments made in the writ petition that the investigation is not being carried out in a fair manner.
The petition lacks merit. It is accordingly dismissed.
