JUDGMENT / ORDER

[1] Heard Mr.Thakkar, learned advocate for the petitioner and Mr.Dave, learned Senior advocate with Mr.Jadeja, for the respondent - University.
[2] At the outset, a point was raised whether the matter should be heard by this Court or by the Tribunal having jurisdiction. There are diverse submissions from both the sides. Let this point be decided first.
[3] Mr.Thakkar, learned advocate for the petitioner states that he shall approach concerned Tribunal by Monday i.e. 28.05.2012.
[4] Propriety demands that exercise of approaching competent forum should not go parallel pending the proceedings before this Court. This petition should end today itself and it is disposed of accordingly.
[5] It is clarified that point of jurisdiction of the Tribunal shall be decided within three days and in the event, it turns out that the Tribunal does not have jurisdiction, it will be open to the petitioner to revive this petition with appropriate amendment.
