Heard learned counsel for the petitioner and learned Standing Consel for the State authorities.
By means of this writ petition the petitioner has come to this Court claiming that certain areas of land were acquired for Ministry of Aviation, Agra. The description of the plots have been given in paragraph 2 of the writ petition. The petitioner is also one of the claimants. After determination of compensation etc., a dispute has arisen between the claimants and the matter is pending before Revenue Court and also this court. All that the petitioner's prayer is that the amount of compensation determined by the authority amounting to Rs.13,58,90,773/- be invested in some interest bearing account till the disposal of litigation amongst the parties so that it may earn interest whereas the amount is lying in Treasury.
Upon query being made as to under which provision compensation amount can be invested in interest bearing account of a Nationalized Bank, no answer is forthcoming.
However, the writ petition is disposed of with the observation that, in case, such an application is made by the petitioner to the concerned District Magistrate namely District Magistrate, Agra, he will consider the same and pass appropriate order in accordance with law.
