JUDGMENT / ORDER

Hon'ble Vedpal,J.
Heard learned counsel for the petitioner and learned Additional Government Advocate.
The petitioner has approached this Court by means of this Writ Petition with the prayer for quashing FIR relating to case crime no. 356 of 2003 under Sections 409, 420, 218, 467, 468 & 471 IPC of Police Station Bihar district Unnao.
We have gone through the contents of the FIR as well as other documents annexed hereto.
As it comes out, the allegations against the petitioner, who happens to be the Cashier of the Bank, are that he had issued cheques. Submission of the learned counsel for the petitioner is that the cheques which are alleged to have been issued by the Petitioner were duly certified by the Block Development Officer and the Manager of the Bank and the petitioner had only issued them and he has no concerned with the offence alleged in the FIR.
In our opinion, since the FIR discloses commission of cognizable offence, as such, the same cannot be quashed.
However, considering the overall aspect of the matter, it is directed that the petitioner shall not be arrested in the above mentioned case crime number till filing of report under Section 169/173 Cr.P.C., as the case may be , provided the petitioner cooperates with the investigation which shall go on.
With the above observations/directions, the petition is finally disposed of.
