The present writ petition has been filed for mandamus directing the respondents no. 2/ Commissioner, Azamgarh Division, Azamgarh to decide the Appeal No. 274 A Computer No. C20014150000668 year 2014-17 under Section 18 of Arms Act, 1959 (Brijenra Kumar Singh Vs. District Magistrate) within specific period as fixed by this Hon'ble Court.
The counsel for the petitioner submits that against the rejection order for grant of arm licence, the petitioner preferred the aforesaid appeal, which is still pending since 2014 and same may be decided by respondent authority within stipulated time as fixed by this Hon'ble Court.
The learned Standing Counsel has no objection to aforesaid submission.
Without entering into the controversy involved in the writ petition, the writ petition is disposed of with direction to respondent no. 2 to decide Appeal No. 274 A Computer No. C20014150000668 year 2014-17 under Section 18 of Arms Act, 1959 (Brijenra Kumar Singh Vs. District Magistrate), expeditiously, preferably within a period of three months from the date of producing a certified copy of this order before the concerned authority, in accordance with law, provided there is no other legal impediment.
It is made clear that this Court has not adjudicated the claim of the petitioner on merit.
