Heard learned counsel for the revisionist and learned A.G.A. for the State respondent.
The present criminal revision has been filed against the order dated 08.02.2010, passed by Principal Judge, Family Court, Jhansi in Case No. 300 of 2006 (Smt Bharti Vs. Brijendra Kumar Sahu) under Section 125 Cr.P.C. wherein maintenance of Rs. 2,000/- per month has been awarded to respondent no. 2 and Rs. 500/- per month for respondent no. 3 from the date of the order.
Issue notice to the respondent nos. 2 and 3 returnable within a period of four weeks. Steps be taken within a week.
Learned A.G.A. prays for and is granted four weeks' time to file counter affidavit. Respondent Nos. 2 and 3 may also file counter affidavit within the same period. As prayed by learned counsel for the revisionist two weeks' thereafter, is granted for filing rejoinder affidavit.
List immediately after expiry of the aforesaid period.
It is directed that the revisionist shall deposits 50% of the arrears of maintenance amount before the Principal Judge, Family Court, Jhansi within one month from today and shall continue to pay the current maintenance allowance month by month before the said court by the 7th day of each calender month.
The amount so deposited by the revisionist shall be duly paid over to the opposite party no.2 after due verification by the Court below.
Subject to the aforesaid deposit as well as payment of monthly maintenance amount, the realization of the remaining 50% of the arrears of maintenance amount shall be kept in abeyance.
In case of default of payment as specified above, interim protection granted by this Court, shall automatically stands vacated.
