1. Rule.
Learned APP, waives service of notice on behalf of respondent.
2. This application is preferred against the order dated 17.11.2011 passed in Criminal Misc. Application NO. 3977 of 2011 by learned Additional Sessions Judge, Court No. 12, Ahmedabad by enlarging the applicant by imposing certain conditions and one of the conditions restricts entry of the applicant in the area of Amraivadi where the applicant resides with his family which costs him undue hardships and, therefore, the learned advocate for the applicant has submitted that the above conditions is unwarranted and by imposing suitable conditions the above condition can be deleted/modified.
3. Heard learned APP.
4. Considering overall facts and circumstances of the case and hardships faced by the applicant and his family, I am inclined to delete the said condition directing the applicant to mark his presence before Amraivadi Police station twice in a month in each of the fortnight till the charge is farmed by the competent Court.
5. This application is allowed accordingly. Rule is made absolute to the above extent.
6. Direct service is permitted.
