Heard learned counsel for the petitioner.
The petitioner has come up in the present petition with a sole prayer that a direction be issued to respondent No. 2-Tehsildar, Tehsil Belthara Road, Ballia to decide the Case No. 899/T- 20111597138 (Brijesh Yadav Vs. Rahmaniya Nursing Home) under Section 34/35 of U.P. Revenue Code, 2006 expeditiously within time bound period.
Considering the facts and circumstances of the case, without adverting into the merits of the case, the writ petition is disposed of with a direction to respondent No. 2-Tehsildar, Tehsil Belthara Road, Ballia to decide the Case No. 899/T- 20111597138 (Brijesh Yadav Vs. Rahmaniya Nursing Home) pending before him expeditiously and preferably within a period of six months without granting any unnecessary adjournments to either of the parties.
In case if any adjournment is inevitable, the authority concerned may grant the same by imposing heavy cost which may not be less than Rs. 500/-.
In view of the fact that due to the pandemic of COVID-19, the certified copy is not being issued by the High Court, therefore, the order downloaded from the website duly certified by learned counsel for the petitioner may be treated as true copy of the order and the Authority may not refuse to comply the order on the ground of non filing of certified copy of the order.
