Heard learned counsel for the petitioner, learned Standing Counsel for the respondent nos.1 to 4 and perused the record.
By way of present writ petition, petitioner has invoked the extraordinary jurisdiction of this Court under Article 226 of the Constitution of India, beseeching correction of revenue record with respect to Plot No.192 (Old number 105), which is recorded as abadi. Petitioner has also sought relief for quashing order dated 12.06.2020 (Annexure-5) passed by the Sub Divisional Magistrate, Nizambad.
It is submitted by learned counsel for the petitioner that plot in question was initially recorded as a pond on the spot but by manipulation it has been recorded as abadi in C.H. Form no.41 and 45 and same has been illegally encroached by some of the persons.
Order dated 12.06.2020 reveals that a representation made by the petitioner, with respect to the alleged encroachment over Plot no.192, has been rejected on the ground that Plot No.192 has been recorded as abadi in C.H. Form no.41 and 45.
Be that as it may, this Court has got no jurisdiction to correct the revenue record as has been prayed by learned counsel for the petitioner. However, he has remedy to approach the authorities concerned for correction of the revenue record or for any manipulation as claimed by the petitioner, by moving appropriate application under the provisions of law as advised.
Accordingly, this petition is dismissed.
