Heard learned counsel for the parties.
Petitioner is the son of ex-employee, who died in harness. Petitioner claims to be 77% disabled. By the instant writ petition, petitioner primarily seeks the following relief:
"issue a writ, order or direction in the nature of Mandamus directing the respondents to decide the claim of the petitioner and allow the family pension to the petitioner in view of Circular/Letter No. F(E)III/2005/PN1/32 New Delhi dated 11.2.2013 issued by the Ministry of Railways (Railway Board, New Delhi) and office memorandum no. 1/33/2012-P&PW (E) dated 16.1.2013 issued by Government of India, Ministry of Personnel, P.G. & Pensions, Department of Pension & Pensioners Welfare, New Delhi within stipulated period."
Learned Standing Counsel submits that the third respondent shall consider and decide the claim of the petitioner expeditiously.
In regard thereto, without entering into the merit of the case, as well as, rival contentions raised by the respective parties, it is provided that the third respondent, Head Chief Commissioner (Protection), Railway Protection Force, East North Railway, Gorakhpur, shall consider and decide the claim/representation of the petitioner, by a reasoned and speaking order, expeditiously, preferably, within two months from the date of filing of certified copy of this order along with the copy of the writ petition.
With the aforementioned observations/directions, the writ petition stands disposed of.
