The petitioner, who is defendant in Original Suit No. 2335 of 1994 has filed the instant petition, seeking a direction to trial court to decide the application for temporary injunction filed by plaintiff-respondent.
It is pointed out by counsel for the petitioner that in the past, in Matter under Article 227 No. 4601 of 2015, this court had issued direction to the trial court by order dated 27.8.2015 to decide the suit expeditiously, but the trial court has not complied with the said direction.
The matter is being adjourned in a routine manner. He states that order of temporary injunction is being extended on every date, without the application being decided finally.
The trial court is directed to decide the application for temporary injunction within a period of 6 weeks from the date of production of certified copy of this order, if there is no legal impediment in that regard. In case, it finds that there is any legal impediment in deciding the application, it shall record reasons in its order for not being in position to decide the application.
The petition stands disposed of accordingly.
