JUDGMENT / ORDER

JUDGMENT Ravindra Singh, J.
1. Heard Sri Manish Tiwari and Sri A.K. Awasthi learned counsel for the applicant and learned A.G.A.
2. This application is filed by the applicant with a prayer that he may be released on bail in case Grime No. 85 of 2005, under Sections 420, 406 I.P.C., P.S. Sirsaganj, Fjrozabad.

From the perusal of the record it appears that in the present case the F.I.R., was lodged by Sri Satish Kumar at the police station Sirsaganj on 8.5.2005 at 7.30 p. m. in respect of the incident which had occurred on 29.4.2005. According to prosecution version the goods of the first informant as washing powder and soap were loaded in Truck No. UP 78-AN- 6908 through a transport company known as M/s Bhaiya Transport Company, Sirsaganj. That truck was loaded for transporting the goods and making delivery to the firm of Vinod Kumar and Hemant Kumar, Shivpur Kala , (M.P.). The expected date of the delivery was 1.5.2005, but the aforesaid delivery was not made: Then the first informant after making an extensive search came to know that the original number of loaded truck was UP 75 F-8377. Its owner was the present applicant Brijesh Singh. He himself had come to the transport company along with a driver and conductor of the truck at the time of loading the goods of the first informant. His truck was bearing a forged number plate. The papers, which were signed by the driver were in the name of Rajveer Singh. It is alleged that he had not disclosed his correct name. The goods loaded on the truck were usurped by the applicant. and others. During the investigation it has been revealed by the evidence that the applicant had come at the Bhaiya Transport Co. along with his driver and helper of the truck and at the fare of Rs. 4500/- the goods of the first informant were loaded on that truck on 29.4.2005 and the number Criminal Misc Bail Application No. 13099 of 2005 plate of the truck was changed at that time In fact the correct number of loaded truck was UP-75F-8377 and the goods loaded on the truck have been sold at Shivpurl through a broker at the cost of Rs. 40,000/- and the same amount has been misappropriated by the applicant. The aforesaid truck was intercepted by the police of P.S. Vikasnagar, Lucknow on 9.5.2005 near the Labha Trading godown. The Driver and Helper of that truck were also arrested by the police along with forged number plate of truck. Its case was registered there under Section 41/411 and 420 I.P.C.

It is contended by the learned counsel for the applicant that the applicant was not having any knowledge in respect of loading of the goods of the first informant and he was not present at the Bhaiya Transport Company when the truck was loaded and he has not made any signature on any paper. Even at the time when the truck was intercepted by the police Vikashnagar, Lucknow. The applicant was not present there, His driver and Cleaner were present there, who were arrested. The allegation that when the truck was inspected it was bearing two number plates. The number plate of front side was bearing number as UP 78AN- 5908 and the number plate of rear side was bearing number UP 75 F- 8377 and there is no other evidence against the applicant to show that he had sold the goods of loaded truck at Shivpur and the cost of goods was misappropriated by him. It is further contended that when the truck was inspected it was bearing correct number plates. The front number plate was fake and no recovery of the alleged goods was made any where and the applicarit was not put up for identification.
5. It is opposed by the learned A.G.A. by submitting that the applicant is owner of the truck. At the time of loading he was present there and he has settled the fare of the truck and he was using his truck by bearing forged number plates. Even the driver of the truck has not, disclosed his correct, name and he disclosed his name as Rajveer Singh whereas his correct name is Satyendra. The applicant himself is having the criminal antecedents and the applicant was using his truck in some illegal transportation and the applicant himself was arrested when his truck was inspected by the police of P.S. Allau ,district Mainpuri on 17.1.2005 and from his truck 215 cartoons of illegal liquor were recovered. The case was registered against him as case crime No. 2 of 2005 under Section 60 of the Excise Act and the applicant himself has changed the number of the truck. The name of the driver was not correctly disclosed since very beginning. It was intention of the applicant and other co-accused to misappropriate the goods loaded in the truck.

It is further contended by the learned A.G.A. that it has come in the evidence that loaded goods were sold through a broker and there is no question of identification because the applicant was known to the first informant and others and the applicant is in jail since 14.6.2005. The time of detention is very short.
7. Considering all the facts and circumstances of the case and submissions made by the learned counsel for the applicant, learned A.G.A. and and without expressing any opinion on the merits of the case, the applicant is not entitled for bail at this stage.
8. According the bail application is rejected at this stage.
