Heard learned counsel for the applicants and learned A.G.A. for the State.
The present revision has been filed to quash the impugned judgmnt and order dated 5.7.2018 passed by learned Chief Judicial Magistrate, Aligarh in Case Crime No. 113 of 2018 (State Vs. Brijesh Kumar and others), under Sections 363, 366 IPC, Police Station Gangiri, District Aligarh.
Admittedly the age of the victim has been determined to be 17 years on the date of the alleged incident. Clearly, she was a minor.
Then by the order dated 5.7.2018, the custody of such a minor has been given to her parents. There can no fault in such order. The prayer made by learned counsel for the applicants that the minor child should have been sent to Nari Niketan, cannot be accepted in view of the fact noted above.
