This Court has perused the report regarding progress made in SCC Suit No. 58 of 2017, Dr. Brijesh Kumar and another vs. Mahesh Chandra Sharma @ Guddu, submitted by the learned Judge, Small Causes Court, Bareilly. The report dated 26.07.2021, this Court must say, is a remarkably well written report. It gives a complete picture of the proceedings of the suit and all events of consequence. A perusal of the report shows that the trial of the suit has reached substantially at an advanced stage where the evidence of the parties is almost over. The last date before the lock-down on account of the Covid-19 pandemic was 16.04.2021 but on that day, in consequence of the lock-down, a general date has been scheduled for 11.08.2021. The said date is yet to arrive.
Now, that proceedings in SCC Suit have substantially advanced, the Trial Judge is directed to proceed with the suit in the manner that effective steps to conclude the trial are taken with utmost expedition, fixing one date every week. The Trial Court shall endeavor to conclude the trial within three months next.
This petition is disposed of in terms of the aforesaid orders.
Let this order be communicated to the Judge, Small Causes Court, Bareilly through the learned District Judge, Bareilly by the Registrar (compliance) within 48 hours.
