Heard Sri Atul Dayal, learned Senior Counsel assisted by Sri Dhananjay Kumar Mishra, learned counsel for the petitioner and perused the record.
Though by means of present petition filed under Article 227 of the Constitution of India, the petitioner has prayed for expeditious disposal of the execution case no. 2 of 2018 but it is admitted that an application under Order XXI Rule 97 of Code of Civil Procedure, 1908 (hereinafter referred to as 'CPC') has come to be filed by opposite party nos. 4 to 8 and now he submits that he is confining his prayer for expeditious disposal of the said application as well as objection under Section 47 of CPC filed by opposite party nos. 1, 2, and 3, as pendency of the said application and objection may come in the way of expeditious disposal of the execution case.
In view of above, this petition stands disposed of with a direction to the court concerned to consider and decide the objection under Section 47 of CPC filed by opposite party nos. 1, 2 and 3 as well as application under Order 21 Rule 97 CPC filed by opposite party nos. 4 to 8 by means of a reasoned and speaking order giving proper opportunity of hearing to all parties concerned expeditiously, preferably within a period of six months from the date of production of copy of this order.
