This appeal was filed by Brij Nandan son of Sukhwasi against the judgment and order dated 22.10.1992 passed by Special Judge (Dacoity Affected Areas), Etawah in Special Case No.15 of 1985.
On 22.07.2019, as no one had appeared on behalf of the appellant, bailable warrants were issued to the appellant.
Pursuant to the above order, the Chief Judicial Magistrate, Auraiya has submitted a report dated 26.08.2019 that Brij Nandan (sole appellant) has died. The report is accompanied by statement of witnesses as also death certificate issued by the hospital concerned which indicates that the appellant (Brij Nandan) died on 02.03.2011.
In view of the above, the appeal stands abated.
The lower court record shall be sent back to the court concerned, unless required in any other appeal/case.
