The grounds taken herein to challenge the order dated 3.11.2018 is that no notice was served upon the petitioner, one of the parties in Land Acquisition Reference No.10 of 2014 (Dinesh Kumar v. Brij Mohan Singh) after the matter was transferred to different courts from time to time.
The submission is that when the transfer was made from one Court to another Court, it was necessary for the transferee Court to put the petitioner, the party in Land Acquisition Reference No.10 of 2014 (Dinesh Kumar v. Brij Mohan Singh), to notice.
Relevant is to note that the petitioner has not filed any recall application before the concerned court i.e. Additional District Judge/F.T.C., Hathras on any of the grounds taken in the present petition. No interference can, therefore, be made.
At this stage, learned counsel for the petitioner prays for and is granted permission to withdrawn the present petition as he proposes to approach the court concerned for redressal of his grievances.
