1. Called in revise. None appeared to press this writ petition. Learned Standing Counsel is present for respondents. In the circumstances, I myself have perused the record.
2. By means of present writ petition, petitioners have sought following reliefs :
"(i) Issue a writ order or direction in the nature of mandamus commanding the respondents to appoint the petitioner on the post of Asstt. Teacher in Primary School (Basic Schools) run and controlled by the U. P. Board of Basic Education.
(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondent no.2, the District Basic Education Officer, Jhansi to accept and entertain the certificate of the petitions.
(iii) Issue a writ, order or direction in the nature of mandamus commanding the respondent no.2, the District Basic Education Officer, Jhansi to call the eligible petitioners who are holders of higher degree i.e. B. Ed., B. P. Ed. and L. T. Degree for interview and consider that their cases for appointment as an instant teacher in primary institutions run and controlled by U.
P. Board of Basic Education in case B. T. C. training holders are not available in requisite number.
(iv) Issue a writ, order or direction in the nature of mandamus commanding the respondents to issue appointment orders to the petitioners who have been finally selected.
(v) Issue any other writ, order or direction of suitable nature as this Hon'ble Court may deem fit and proper in the circumstances of the case.
(vi) Award costs of the petition to the petitioners."
3. I myself have gone through the pleadings, grounds as also reliefs sought and find that petitioners are not able to make out a case so as to justify interference of this Court by granting reliefs, as prayed for.
4. Moreover, it appears that either the cause of action no more survives or the petitioners have lost interest in this matter or it has otherwise become infructuous and, probably for this reason, none is interested to have decided this matter on merits and that is why, counsel for petitioners is absent.
5. Dismissed. Interim order, if any, stands vacated.
