Heard Sri Kamlesh Kumar Dwivedi, learned counsel for the applicant as well as learned AGA for the State and perused the record.
Present application under section 483 Cr.P.C. has been filed by the applicant seeking a direction to the Civil Judge(Junior Division)/Judicial Magistrate, Khaga, Fatehpur to decide the Criminal Case No.136/2017(Old Case No. 424/2016) Brij Kishore Kesharwani vs. Bangali Babu @ Bangali & others under section 380, 504, 506 IPC, Police Station Khaga, District Fatehpur, within a stipulated period.
It is submitted by the learned counsel for the applicant that the aforesaid case is pending since 2016 and could not be decided due to delaying tactics adopted by opposite party No.2 and only prayer is to direct the Court concerned for expeditious disposal of the same.
Learned AGA has no objection to the prayer made in this application.
Without going into merit of the case, it is appropriate that the aforesaid case be decided expeditiously.
In view of above, the Civil Judge(Junior Division)/Judicial Magistrate, Khaga, Fatehpur is directed to expedite and conclude the proceedings of Criminal Case No.136/2017(Old Case No. 424/2016) Brij Kishore Kesharwani vs. Bangali Babu @ Bangali & others under section 380, 504, 506 IPC, Police Station Khaga, District Fatehpur within one year from the date of production of copy of this order.
With aforesaid direction, the application under Section 483 Cr.P.C. is finally disposed of.
