Supplementary affidavit filed today, is taken on record.
The petitioner is seeking payment of encashment of privilege leave as per the staff circular no.17 file no. 41 dated 27.06.2018. Submission of the petitioner is that he had earlier filed Civil Misc. Writ petition No.1073 of 2019, wherein he was permitted to withdraw the writ petition on the ground that he proposed to approach the General Manager for redressal of his grievance.
While disposing of the aforesaid writ petition, this Court had directed the General Manager to take decision on the application of the petitioner within a one month. The contention is that the judgement and order dated 22.01.2019 was sent to the General Manager (respondent no.1) through registry on 09.02.2019. However, till date there is no decision. Submission is that the entitlment of the petitioner to seek encashment of privilege leave has yet not been considered by respondent no.1.
On these submissions, no instruction has been received by the learned counsel for the respondents.
Be that as it may, without expressing any opinion as to the merits of claim of the petitioner, the present petition is being disposed of with the direction to the General Manager, Central Bank of India, Personal Department, Central Office, Chandra Mukha, Narinman Point, Mumbai (respondent no.1) to take expeditious decision in accordance with the circular of the Bank and the relevant rules after inviting comments from the office concerned, as expeditiously as possible, preferably, within a period of one month from the date of submission of the certified copy of this order.
In case of any non compliance on the part of respondent no.1, it would be open to the petitioner to seek appropriate remedy.
