Notice on behalf of opposite party Nos.1 to 5 has been accepted by the learned Chief Standing Counsel. For the order proposed to be passed in this writ petition, issuance of notice to opposite party Nos. 6 and 7 is dispensed with. The writ petition has been filed seeking following reliefs:-
"(i) to issue a writ, order or direction in the nature of Mandamus commanding the opposite party No.2 to take action against the opposite parties No.6 and 7 and restrain them in taking forceful possession over the land Gata No.238, situated in Village Karimabad, Tahsil and District Lucknow, in the interest of justice;
(ii) to issue any other writ, order or direction which this Hon'ble Court may deem just and proper in the circumstances of the case;
(iii) to allow the writ petition with costs."
After going through the writ petition and hearing parties' counsel, we are of the view that there is some dispute of civil nature between the petitioner and private respondents, i.e., opposite party Nos. 6 and 7. Sri Dileep Kumar, learned counsel for the petitioners makes a statement at the Bar that he may be permitted to withdraw this writ petition with liberty to approach the appropriate forum as provided under U.P. Revenue Code, 2006. The writ petition is accordingly dismissed with the aforesaid liberty.
