This writ petition has been filed with the grievance that though disciplinary action has been initiated against the petitioner but the list of witnesses has not been supplied to the petitioner by the Enquiry Officer. It is stated that a claim in that regard has been raised before the Enquiry Officer but no decision has yet been taken.
Petition is opposed by Sri Amrish Sahai, learned counsel for the respondent Bank.
Perusal of the record would go to show that a charge sheet has been served upon the petitioner on 11.2.2019. It is thereafter that petitioner has made an application for providing the list of witnesses to the petitioner.
Learned counsel for the petitioner states that enquiry proceedings are fixed for being considered next on 2.5.2019. This Court is of the view that at this stage no intervention would be warranted in the matter inasmuch as there is nothing on record to show that Enquiry Officer has refused to entertain petitioner's application. In between 11.2.2019 and next date i.e. 2.5.2019 no order appears to have been passed which has prejudicially affect the petitioner. During the continuance of enquiry proceedings this Court would otherwise not like to intervene.
Leaving it open for the petitioner to press his grievance before the Enquiry Officer, which is expected to be dealt with in accordance with law, this writ petition is consigned to records.
