Counter affidavit has been filed on behalf of respondents no.1 to 5 by Sri Manoj Kumar Srivastava, Advocate, which is taken on record.
It has come in the counter affidavit that the petitioner's disciplinary proceedings have been completed and final punishment order has been passed on 06.10.2018 fixing a liability of Rs.36,30,321/- upon the petitioner. The petitioner is being given provisional pension and payment of his retiral dues can be made after due calculation within a short period after adjustment of the aforesaid recovery to be made from his dues.
Learned counsel for petitioner shows that now pleadings have come on record by way of a counter affidavit. The petitioner will have to file a fresh writ petition and he prays that this writ petition be dismissed as withdrawn and he may be given a liberty to file a fresh petition.
The prayer as made, is allowed.
The writ petition is dismissed as withdrawn with liberty to the petitioner to file a fresh writ petition.
