Sri Ashutosh Vaish has appeared for the respondent nos.3 to 5.
Petitioner is a retired employee of the respondent Organization and was receiving provisional pension. He has approached this Court with the grievance that even provisional pension has been discontinued. Taking cognizance of such grievance, this Court proceeded to pass following orders on 17.5.2019:-
"Grievance is that the petitioner's provisional pension also has been withheld for the last three months. Submission is that there exists no justification for the respondents to withhold petitioner?s provisional pension. It is also submitted that the respondents ought to have finalised petitioner's regular pension, by now.
Sri Ashutosh Vaish and Sri Amit Krishna, appearing for the respondents may obtain instructions in the matter.
Post as fresh on 24.5.2019."
Today when the mater is taken up, Sri Amit Krishna appearing for the respondents has produced instructions received from the authority concerned, as per which the arrears of provisional pension has been deposited in the account of petitioner on 27th May, 2019. Copy of the instructions as well as retirement benefit bills etc. has also been furnished to the counsel for the petitioner. Such instructions are also taken on record.
In view of the above, it is apparent that relief prayed for in the writ petition has already been granted. Writ petition, accordingly, is rendered infructuous.
