Order: (per Hon’ble Sri Justice Sanjay Kumar) This Public Interest Litigation was taken up on the basis of a letter addressed by the petitioner herein. The cause for grievance was the alleged failure on the part of the Greater Hyderabad Municipal Corporation in maintaining the roads in Hyderabad, including construction of pavements and checking illegal occupation and removing thereof if any of the existing pavements.
This Court, by its order dated 30.12.2013, directed the Greater Hyderabad Municipal Corporation to undertake all lawful measures for removal of encroachments on the pavements and to submit a progress report. Accordingly, a progress report was submitted setting out the measures taken by the Corporation for removal of the encroachments and also for repair of the roads. The matter was thereupon adjourned to enable filing of a fresh report after taking further steps as regards the issue. The latest report submitted by the Greater Hyderabad Municipal Corporation is dated 10.10.2014 and records that the Corporation had earlier undertaken removal of 17988 encroachments on the foot paths in the city with the help of traffic police and thereafter, 2847 temporary encroachments were also removed from 19.4.2014 to 6.10.2014. The Corporation undertook that it would continue this drive vigorously with the help of the traffic police so that smooth flow of traffic is maintained and foot paths are left free of encroachments for use by the pedestrians. We take on record the said undertaking of the Corporation. The Corporation shall strive to undertake all lawful measures as and when required to keep the pavements free from all encroachments apart from maintaining the roads in the city.
The Public Interest Litigation is closed. Pending miscellaneous applications shall stand closed in the light of this final order. No order as to costs.
