JUDGMENT / ORDER

THE HONOURABLE Dr. JUSTICE S.VIMALA M.P.No.1 of 2006 and C.M.A.SR.No.27942 of 2006 Prayer : M.P.No.1 of 2006 filed under Section 173(1) of Motor Vehicles Act, seeking condonation of delay of 256 days in filing the Civil Miscellaneous Appeal.
Prayer : C.M.A.No.SR27942 of 2006 filed under Section 173 of the Motor Vehicles Act, 1988, against the Judgment dated 17.03.2005 made in M.C.O.P.No.626 of 2004 on the file of the Motor Accident Claims Tribunal (Chief Judicial Magistrate), Dharmapuri.

ORDER
The Insurance Company has filed an appeal along with this petition to condone the delay of 256 days in filing the appeal as against the award dated 17.03.2005 made in M.C.O.P.No.626 of 2004 on the file of the Motor Accident Claims Tribunal (Chief Judicial Magistrate), Dharmapuri.
2. Today, when the condone delay petition came up for hearing, the learned counsel for the petitioner/Insurance Company submitted that the Insurance Company has already deposited the entire award amount, along with interest and the claimants have also withdrawn the same and hence, nothing survives for adjudication.
3. Having regard to the above submissions made by the learned counsel for the petitioner/Insurance Company, condone delay petition is dismissed. Consequently, CMA(SR) is rejected. No costs.
