Heard learned counsel for the applicant and learned AGA for the State.
The present application u/s 482 CrPC has been field seeking quashing of the entire proceedings of Case No.1442/9/1999 arising out of case crime no.185 of 1996 under Section 302 IPC PS Khatauli District Muzaffar Nagar pending before the CJM Muzaffar Nagar and also for quashing the impugned order dated 28.6.2019 by means of which NBW and proceedings under Section 82/83 CrPC were initiated against the applicant.
I have perused the impugned order. I find that the non bailable warrant was issued against the applicant on 28.6.2019 and the proceedings under Section 82/83 CrPC were also initiated against him. I do not find any illegality or perversity in the impugned order. Thus, the prayer as made is hereby refused.
However, in case the applicant surrenders and applies for bail before the court concerned within two weeks from today, the same shall be considered and decided in accordance with law of the land.
Liberty is also given to the applicant that in case he has any further grievance, he may raise the same in earlier application u/s 482 CrPC which is said to be pending as on date.
With the aforesaid observation, the application is disposed of finally.
