Heard learned counsel for the petitioners and the learned AGA appearing for the State respondents.
By means of the present writ petition, petitioners have prayed for a writ of mandamus commanding the respondent No.1 to transfer the investigation of case Crime No.939 of 2010 lodged with police Chowki Dhakia, Police Station Sahabad, District Rampur under Sections 323, 324, 307 I.P.C. from the local Police Rampur to some other independent investigating agency.
We have gone through allegations made in para 12 of the writ petition. We find that an application under Section 156 (3) Cr.P.C. was moved against the Police authority by the brother of the petitioners and not by the petitioners. The same was rejected by the Magistrate. Revision against the order of the Magistrate is pending, in which no interim relief has been granted.
However, we direct that if the petitioner approaches the Superintendent of Police of the District concerned with the copy of this order, then Superintendent of Police shall pass suitable orders for ensuring free and early investigation of the case and if need be to change the investigating officer.
With the aforesaid direction/ observation, writ petition is disposed of finally.
