Heard Shri Satendra Tripathi, learned counsel for the applicant, Kumari Meena, learned AGA for the State and Shri Kesh Mani Dubey, learned counsel for respondent no.2.
The present application has been filed for quashing the order dated 25.6.2019 passed by Addl. District & Sessions Judge 6th, Ghaziabad in ST No.461/17 (State vs Vijay @ Bobby) under Sections 302, 306, 342, 323, 504 IPC PS Kotwali District Ghaziabad, arising out of Case Crime No.347/2017.
Contention of the learned counsel for the applicant is to the effect that the applicant filed an application before the court below on 4.6.2019 to take the C.D. on record for the purpose of adjudication in the trial. This application has been rejected by the impugned order dated 25.6.2019 which is under challenge in the present application.
I have perused the said application as well as the impugned order dated 25.6.2019, which shows that the court concerned while deciding the said application 28 Kha has clearly recorded the findings herein as under:-

**foospuk ds nkSjku vfHk;kstu dh vksj ls lEiw.kZ ekSf[kd] vfHkys[kh; ,oa bysDVªksfud lk{; izLrqr djus dk volj Fkk fdUrq mDr vof/k esa dfFkr lh-Mh- vfHk;kstu }kjk nkf[ky ugha dh x;h vkSj u gh mDr lh-Mh- iwoZ esa nkf[ky u fd;s tkus dk dksbZ dkj.k n'kkZ;k x;k gSA iz'uxr lh-Mh- ds lEcU/k esa ;g Hkh Li"V gh fd;k x;k gS fd mlesa fdldh vkokt ;k fQYe gS rFkk mldh vUroZLrq D;k gSA u gh fdlh lk{kh ds vfHkdFkuksa ls bldk dksbZ mYys[k gqvk gSA vr% izkFkZuki= fujLr fd;s tkus gsrq fuosnu fd;k x;kA** After hearing the learned counsel for the applicant, learned A.G.A. and after perusing the order impugned as well averments made in the present application, this Court is of the opinion that learned counsel for the applicant could not point out any illegality or perversity in the order impugned which may warrant any interference by this Court.
Accordingly, the application u/s 482 CrPC lacks merit and is dismissed.
