Heard Sri Satish Kumar Yadav, learned counsel for the petitioners, Sri Ashish Kumar Srivastava, learned counsel for the Gaon Sabha and learned Standing Counsel for the State respondent no.1.
The petitioner is before this Court with request to restrain the respondents not to mutate the Gata No. 282/0-60 in favour of the Gaon Sabha till disposal of stay application and revision No. 771 of 2018 (Brajesh and others Vs. Gaon Sabha and others) and as well as direct to respondent to maintain status quo during the pendency of the present writ petition.
Learned Standing Counsel fairly states that in case the aforesaid case is still pending and has not been disposed of, the same will be considered and decided expeditiously.
In view of the above, on consent and without expressing any opinion on the merits of the issue and considering the facts and circumstances of the case, this writ petition is disposed of finally with a direction to the first respondent to decide the aforesaid stay application in Revision No. 771 of 2018 after giving opportunity of hearing to the private respondents, as expeditiously as possible and preferably within a period of three months from the date of production of a certified copy of this order before him, without granting unnecessary adjournments to either of the parties, except upon payment of cost of Rs.250/-.
