Heard Sri Kaushal Kishore Tewari, learned counsel for the petitioner and learned A.G.A.
This petition has been filed for a writ, order or direction in the nature of mandamus thereby directing the opp. party nos. 1 to 3 to investigate the case and arrest the accused persons of case crime No.0563 of 2020 under Sections 376, 34, 323, 324, 452, 427, 504, 506 of IPC registered at police station Kheri, District Lakhimpur Kheri as early as possible.
After arguing at some length, learned counsel for the petitioner submits that Investigating officer is not conducting the investigation in a fair manner and confines the relief to the extent that the representation filed before the opposite party may be directed to be considered expeditiously.
Learned A.G.A. has no objection to the above prayer of learned counsel for the petitioner.
Considering the submissions made by learned counsel for the parties and going through the record, the writ petition is hereby disposed of with the direction to respondent No. 2 to consider the representation already moved by the petitioner on 21.1.2021 (contained in Annexure No.5 to the writ petition) and on his satisfaction may take necessary action in accordance with law expeditiously and preferably within a period of two weeks from the date a certified copy this order is produced before him.
