Heard learned counsel for the petitioners and the learned Standing Counsel.
All the petitioners are Diploma holders who had been appointed as Assistant Technicians on contractual basis. They challenge the orders dated 10 April 2018, 21 April 2018 and 22 June 2018. In terms of these orders, the District Magistrate has provided that projects under MGNREGA and other Governmental schemes must be technically evaluated and assessed by Junior Engineers of the Rural Engineering Services.
This directive has been issued in order to ensure that public funds are appropriately utilized. The Court finds no merit in the challenge levelled against these orders since the mere fact that the petitioners have not been asked to discharge these functions does not interfere with any stipulated condition of service. Ultimately the manner in which expenditure is to be incurred out of public funds and necessary checks and balances placed must be left in the provence of the respondent authorities.
The writ petition lacks merit and is dismissed.
