Petitioners' counsel was confronted with the Division Bench judgment of this High Court and he has gone through the same and he has felt that subsequent allottee have no right, title or interest to continue in view of the decisions in Poonam Vs. State of U.P. and Ors. 2015 LawSuit (SC) 1088 and Manju Devi Vs. State of U.P., LAWS (All) 2017 (3) 173 which have been recently followed by the Division Bench in Special Appeal No. 676 of 2018 decided on 06.08.2018 and Special Appeal No. 669 of 2018 decided on 03.08.2018 (by Hon'ble Chief Justice D.B.Bhosale and Hon'ble Justice Yashwant Verma) and, therefore, he request this Court to permit him to withdraw the petition as otherwise the petition would be dismissed on merits.
The request for withdrawal of the petition, at this stage, is granted.
