Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record.
Learned counsel for the applicant submitted that one accident took place in which a girl died by a Truck. The villagers agitated and there was protest on their behalf in which some persons fired. However, on the basis of false allegation F.I.R. was lodged against 12 persons including the applicant. Specific role of fire was assigned to co-accused namely Prabhakar Awasthi causing the fire arm injury to the deceased. The prayers for bail of co-accused namely Rajan Alias Vishnu and Anand Bihari Dixit @ Bachcha have already been allowed by this Court on 21st-24th May, 2010 respectively. The applicant is in jail since 10.05.2010.
In view of aforesaid fact and without observation on merit, let the applicant namely Braj Bihari Dixit be released on bail in Case Crime No. 107 of 2010, under Sections 147, 148, 149, 302, 394, 411, 436, 286, 34 I.P.C. and 7 Criminal Law Amendment Act, Police Station Kotwali Nagar Banda, District Banda on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the Court concerned.
