1. Present petition is listed for hearing today for first time before this Court.
2. The petition has been for first time assigned to this Court by order dated 30.10.2012 passed by Hon'ble the Chief Justice and thereafter, it is listed today for first time.
It appears from the record that the election petition was filed on or around 29.10.2009.
3. It appears that, after the order dated 15.10.2012 passed by the Court (Coram: Hon'ble Mr. Justice S.R.Brahmbhatt), Hon'ble the Chief Justice has passed the said order dated 30.10.2012, pursuant to which, the election petition is, now, for first time, assigned to and placed before this Court today.
4. From the record, it appears that until now, issues are not framed.
5. It appears from the record that present petition was filed on or around 29.10.2009.
6. Today, when the petition is called out and taken up for hearing, the petitioner, party-in-person, is present. However, the learned advocate for the contesting respondent is not present.
7. Election Petitions are required to be heard expeditiously, however, considering the fact that this petition is placed before this Court today for the first time and bulky record has to be examined and since learned counsel for the respondents is not present.
8. Having regard to the request made by the petitioner, party-in-person, S.O. to 9.11.2012.
