Heard learned counsel for the petitioner and Km. Meena, learned A.G.A. for the State.
This writ petition has been filed with the prayer to issue a writ, order or direction in the nature of mandamus commanding the respondent no. 5 to conclude the investigation [under section 173(8) Cr.P.C] of Case Crime No. 1791 of 2016 under sections 420, 467, 468, 471, 506 IPC, Police Station Indirapuram, District Ghaziabad.
The prayer made in this writ petition is misconceived.
It appears that initially the charge sheet has been submitted thereafter the matter was directed to be further investigation.
Considering the facts and circumstances of the case and without expressing any opinion on the merits of the case, the writ petition is disposed of with liberty to the petitioners to approach the respondent no. 4 by means of proper application, raising their grievance therein, along with certified copy of this order within a period of three weeks and in case such application is filed the respondent no. 4 will personally look into the matter and will ensure the appropriate action in accordance with law.
With the aforesaid observation, the writ petition is disposed of.
