Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Abhishek Sharma, learned counsel for respondent-Bank.
Learned counsel for the petitioner disputes that the amount being claimed by the Bank to have been sanctioned towards the loan is not correct.
Learned counsel for the petitioner has stated that petitioner was sanctioned a loan of Rs.42,840/- only, which was repaid to the Bank in the year 2017 and as per the statement of the petitioner, there are no dues against him.
Sri Abhishek Sharma, learned counsel for respondent- Bank disputes the above contention of learned counsel for the petitioner on the ground that he was sanctioned a total amount of Rs.90,000/- as loan and not Rs.42,840/- as claimed by the petitioner.
The dispute being raised before this Court is on factual nature. The petitioner is at liberty to file suit or avail any other remedy available to him in accordance with law, within a period of two months.
For a period of two months, no recovery shall be effected against the petitioner by the Bank.
With the aforesaid observations, this writ petition is disposed of.
