The petitioner has approached this Court aggrieved by the order passed by the District Collector under Act 28 of 2008. The petitioner as per Ext.P3 is ordered to restore the reclaimed paddy land in contravention of Act 28 of 2008. The petitioner has a case that this is not a paddy land. According to the petitioner, this was reclaimed before Act 28 of 2008. The petitioner has already approached the Local Level Monitoring Committee by Ext.P4 to correct the entries in the draft data bank. Therefore, the Local Level Monitoring Committee shall conduct a site inspection and find out whether this can be classified as a paddy land as on the date of enactment of Act 28 of 2008. The Local Level Monitoring Committee shall take up Ext.P4 within a period of six weeks and to pass appropriate orders thereon after conducting site inspection and hearing the petitioner. 2 entries are corrected, the District Collector shall recall Ext.P3 order. However, if the entries are not corrected, the revenue authorities are free to take appropriate action according to Act 28 of 2008 based on Ext.P3. Till a decision is taken by the Local Level Monitoring Committee on Ext.P4, status quo shall be maintained.
Writ petition is disposed of as above.
