Respondent/Complainant Petition under Sections 437 & 439 of Cr.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to release the petitioners on bail pending investigation, enquiry and trial in to Crime No. 11 of 2014 of K.V.B. Puram Police Station, Chittoor District in the interest of justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein and upon hearing the arguments of Sri D.Purnachandra Reddy, Advocate for the Petitioners and of the Addl. Public Prosecutor, for the Respondent, the Court made the following.
ORDER:
“This is a petition by A2 and A3 seeking for grant of bail. The learned Additional Public Prosecutor submitted that there are no instructions. This Petition is disposed of without the learned Additional Public Prosecutor receiving instructions from police.
The petitioners have been in jail since 10.3.2014. They allegedly committed offences under Section 302 read with Section 34 IPC. It is the case of the prosecution that A2 beat the deceased on his face and A3 pushed aside the deceased, resulting in the death of the deceased. It is the contention of the learned counsel for the petitioner that there was no intention on the part of the accused to cause the death of the deceased. He further submitted that on account of civil disputes between the family of the deceased on one side and the accused on the other side, this case was foisted against the petitioners. In view of the nature of the defence set up, I consider it appropriate to enlarge the petitioners on bail.
Consequently, this Criminal Petition is allowed. The petitioners are enlarged on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties each in a likesum to the satisfaction of the learned Junior Civil Judge/Judicial First Class Magistrate, Srikalahasti, Chittoor District.”
