Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct to enlarge the Petitioners/A1 & A2 on bail in the event of their arrest in connection with Crime No. 52 of 2014 of Pedavegi Police Station, West Godavari District in the interest of justice.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri Kambhampati Ramesh, Advocate for the Petitioners and of the Public Prosecutor on behalf of Respondent-State, the Court made the following.
ORDER:-
“The petitioners are A1 and A2. They seek for grant of anticipatory bail. They allegedly committed an offence under Section 306 IPC. The husband of the first petitioner committed suicide. The case of the prosecution is that the first petitioner, who is the wife of the deceased and the second petitioner, who is the mother-in-law of the deceased harassed the deceased to such an extent that the petitioner committed suicide. The further case of the prosecution is that the deceased informed his parents that he was committing suicide on account of the conduct and attitude of his wife and mother- in-law. However, there is no allegation that either the wife or the mother-in-law of the deceased abetted or instigated the deceased to commit suicide. Where the petitioners are women, in view of the nature of the allegations against the petitioners, I consider it appropriate to enlarge the petitioners on anticipatory bail.
Accordingly, this Petition is allowed. The petitioners shall surrender before the Special Judicial Magistrate of First Class(Prohibition and Excise Cases) Eluru, within two weeks from today. On such surrender, the learned Special Judicial Magistrate of First Class(Prohibition and Excise Cases) Eluru, shall enlarge the petitioners on bail on a bond of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties each in a like sum to his satisfaction.”
