THE HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.4467 of 2013 ORDER :
When the matter is taken up for consideration, learned counsel for the petitioner submits that the petitioner has offered to pay an amount of Rs.75,00,000/- with reference to the barge Boppana 3 which was lying in the fishing harbour and barge at WQ-6 and since there was no claimant earlier, the Visakhapatnam Port Trust conducted auction of the barge and crane and 3rd respondent purchased the same. On the offer made by the petitioner, the Visakhapatnam Port Trust in its letter No.ITRA/FDF, dated 20/26.06.2014 informed the petitioner that the proposal for release of the two Barges made by the petitioner would be considered in the next Board Meeting subject to the petitioner withdrawing the writ petition pending before this Court.
2. Having regard to the letter written by the Visakhapatnam Port Trust, to pursue the matter with Visakhapatnam Port Trust, the petitioner seeks to withdraw the writ petition with the leave of the Court.
3. The petitioner is permitted to withdraw and accordingly, the Writ Petition is dismissed as withdrawn. No costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
4. Interim order granted on 14.02.2013 is hereby vacated.
