ORDER:
Petitioner, who is a resident of Srinivasa Colony, L.B. Nagar, filed a complaint dated 24.01.2012 before the respondent police followed by other complaints including last one dated 24.09.2013 complaining that the Church in the Sri Shankar Colony is utilizing loud speakers and creating serious sound pollution. A request made by the entire colony people with the Church has not produced any result and therefore, the aforesaid complaints were filed before the respondent police and alleging inaction on the part of the respondent police, the present writ petition is filed.
2. Instructions received by the learned Assistant Government Pleader for Home state that on the complaint of the petitioner, the police personnel of the L.B. Nagar Police Station have enquired the matter with the Church officials and recorded the statement of the Pastor, Mr. D. Benjimen, wherein it is stated that only at the anniversary of the church on 26.01.2014, they were practising songs by using loud speakers. The police also recorded the statement of the Chairperson of the Agape Baptist Church wherein the Chairperson assured the police that hereafter they would keep the minimum sound on the public address system and follow the guidelines of the Supreme Court in using the loud speakers and in case of any violation of the guidelines, the police can take action against the Church.
The instructions further state that since the Church authorities are appropriately warned by the police, if any deviation is noticed by the police necessary steps and appropriate action will be taken against the church.
3. In view of the aforesaid instructions, therefore, the grievance of the petitioner stands completely redressed and hence, no further orders are necessary to be passed in the writ petition.
The writ petition is disposed of. As a sequel, miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
